What to Do When Stopped If You Have Been Drinking

1. Pull over immediately, in a safe place out of the traffic lanes and remain in vehicle.

2. Roll down your window just a crack, and hand the officer your license, proof of insurance and registration.

3. The officer may ask you if you have been drinking, in an attempt to collect evidence to justify an arrest. You do not have to answer, politely decline to answer and request a private call with your attorney.

4. If the officer asks you to take a field breathalyzer or field sobriety test, politely decline to do so. Again, request a private call with your lawyer and call Jonathan Warshaw at (480) 390-2537.

5. If arrested, do not decline to take the blood or breath test, because doing so will result in an automatic one-year loss of your driver's licence.

6. Make sure to vividly remember all the facts in your arrest, such as what the officer said to you and what you said. This will be important when getting your case dismissed or fighting your case in court.
